Tenmeya Creator Platform Agreement

This Agreement outlines the terms and conditions between the Creator (“you”) and Tenmeya (“we”, “our”, or “Tenmeya”) regarding the hosting and sale of digital courses through our platform.

1. Definations

  • Content: Means all data, information, and material, including, but not limited to, texts, pictures, photographs, software, videos, music, sounds, and graphics.
  • Services: Means the provision of online training materials, including videos, courses, educational resources, and any associated support or guidance offered by Tenmeya to its users or subscribers through its digital platform. 
  • Tenmeya: Means Tenmeya application company for managing training and development institutes, a company located in Kuwait City, Kuwait.

 

Terms and Conditions: Means this document, including any policies and guidelines referenced herein, governing the use of the Tenmeya platform.

2. Packages

3-month professional sales funnel (including landing page design and email sequence templates).

  • 3-month subscription to Tenmeya for course hosting.
  • Marketing consultation with Eid Al Mujaibel (1 hour).
  • Connection to local payment methods.
  • Dedicated account manager (responsible for [briefly outline responsibilities]).
  • 90% revenue share to the Creator, 10% to Tenmeya.
  • Price: $999 (introductory offer: $499 for the first 10 creators).
  • For influencers or content creators with a ready-made course (meeting Tenmeya’s format requirements as outlined in Section 2).

3. Onboarding Process

Once a package is purchased:

  • A confirmation email will be sent.
  • You must schedule a call with your account manager.
  • You will attend an onboarding meeting with your account manager:
    • Welcome.
    • Discuss your course structure.
    • You will be shown different funnel templates and will select your preferred template. 
    • Show how your course will appear in the app and how community features work.
    • Discuss final deliverables.

Once all deliverables are submitted, we will be able to launch the course and make it live in the app within 8 – 10 business days.

  • If your course is ready, it must follow Tenmeya’s format:
    • Course duration should not exceed 1 hour.
    • Each video must be vertical and include a multiple-choice quiz after each lesson or module, which is optional.
    • Required components:
      • Intro video (course overview).
      • Outro video (suggest rating the course and generating the course certificate).
      • Lesson titles.
      • Course resources (if available in PNG & PDF format, along with the title).
      • Target audience (“who is this course for”, minimum 4 options).
      • Testimonials (if available).
      • Professional title / Designation.
      • Profile photo.
      • Bio.
      • Image for the course cover in 1080*1080 size.

4. Landing Page And Templates

  • Each course will have a landing page created by Tenmeya using predefined templates. Previews of these templates will be provided.
  • You will be assigned a subdomain (e.g, yourname.tenmeya.com).
  • Once a template is chosen, it cannot be changed for 3 months.
  • Headline, price, and text copy can be updated once a week upon request (limit of 2 updates per week).
  • To request updates, you must submit a support ticket.
  • Requests will be fulfilled within 2 to 3 business days.
  • No new elements or features can be added to the landing page.

5. Course Hosting And Sales

  • Only one course may be hosted per creator per package.
  • You may create up to 12 Circles maximum 4 per month.
  • All course and Circle details must be submitted by you.
  • You may communicate with your customers via the app.
  • Only courses and directly related materials (e.g., downloadable resources, worksheets) are allowed on the platform.

6. Revenue And Payouts

  • You receive 90% of all course sales revenue; Tenmeya retains 10%, which includes payment processing fees and potential foreign exchange losses. Therefore, Tenmeya’s actual net revenue share is approximately 5-7%.
  • All transactions on Tenmeya are processed in Kuwaiti Dinars (KWD). Payouts will be made to your bank account in Kuwaiti dinars (KWD).
  • You must provide your bank details for payouts.
  • Payments are processed within 7 business days after the last day of the month. (For example, revenue earned in April will be processed by May 7th).
  • There is no minimum revenue threshold required for a payout.
  • The price set by the creator is not the exact amount they will receive upon selling a course. Deductions for fees and other charges will apply. To assist in determining the optimal pricing strategy, a calculator tool is provided by Tenmeya.
  • If the creator’s bank account is located outside of Kuwait and their local currency is different from KWD, any charges levied by their bank for receiving the transfer in a foreign currency will not be covered by Tenmeya.
  • Creators are responsible for all applicable taxes in their respective countries. These taxes will not be handled or covered by Tenmeya.

7. Refund And Course Submission Policy

  • You must submit your course content course within 30 days of payment. You will receive reminders during this period.
  • If you change your mind after subscribing to any package, you may request a refund within 14 days of purchase, provided that you have not submitted a course.
  • Refunds will be processed within 14 business days.
  • When a customer requests a refund, they must do so within 30 days of the original purchase. Tenmeya will then process the refund within 3-5 business days. 
  • Refunds will be deducted from the creator’s future payouts. Tenmeya will handle the refund processing fees, but any non-refundable payment gateway fees will be communicated clearly to the creator.
  • Foreign exchange loss and payment gateway fees will be taken care of from the creator’s future payout. Tenmeya will not be liable for paying any additional charges from the creator’s side to their customer.

8. Content Standards & Quality Control

  • Vertical video format is mandatory (to ensure optimal viewing on mobile devices). If you do not have an in-house editing team and require assistance with editing your videos into the vertical format, Tenmeya can provide this service for an additional fee. We will edit your videos in your desired style.

9. Customer Data

  • Tenmeya retains ownership of customer data.
  • You may request a copy of your customer list at any time (provided in CSV format).
  • Tenmeya may use customer data for platform improvement and marketing purposes.

10. Disputes

  • In case of a dispute with a customer or with Tenmeya, all parties agree to try resolving the matter amicably first through communication with your account manager. If unresolved, further steps for dispute resolution will be outlined by Tenmeya.

11. Promotion Guidelines

  • Tenmeya provides a platform for hosting and selling courses and offers sales funnel creation and marketing consultation as part of their packages. However, the ultimate success of course sales and promotion efforts relies on the creator’s engagement and the quality of their content. Tenmeya’s role is to provide the tools and infrastructure, not to guarantee specific sales figures or manage advertising campaigns beyond the scope defined in their packages.
  • External links that redirect to competing platforms or unrelated services are not allowed without prior approval from Tenmeya (approval process: submit a support ticket with details of the link).
  • Misleading promotions or claims will lead to removal from the platform.

12. Course Updates

  • You may update your course content after publication by raising a request to your account manager.
  • All changes must follow Tenmeya’s course structure and be approved by Tenmeya.
  • Updates will be reflected within 2-3 business days.

13. Platform Downtime

  • We will inform you in advance of any maintenance or downtime via email.
  • Refunds or extensions will only apply if downtime exceeds seven consecutive days.

14. Termination

  • Tenmeya reserves the right to remove or restrict access to your content if you violate these terms (examples include copyright infringement, hate speech).
  • Misuse of customer data or plagiarism will result in permanent removal without refund.
  • Upon completion of your 3-month contract with Tenmeya, you will be reminded 7 days before the end of your contract to renew.
  • If you do not renew your contract before the expiry date, your course will be removed from the app, and your landing page will no longer function.

15. User Obligations

  • Use the website and the Services delivered in accordance with these Terms and Conditions and in an appropriate and lawful manner. 
  • You shall not receive, access, transmit, or broadcast any content which is unlawful or in breach of any Intellectual Property Rights (including copyrights).
  • You shall not use the website and/or the Services to advertise or offer to sell any goods or Services for any commercial purpose without Tenmeya’s written consent.
  • You shall not transmit any electronic content (including viruses) through the website, which causes or is likely to cause detriment or harm to Tenmeya or others. 
  • You shall not attempt to gain unauthorized access to any of Tenmeya’s Services, other accounts, computer systems, or networks connected to any of Tenmeya’s Services through hacking or any other means. 
  • Tenmeya reserves the sole discretion to deny or restrict your Service, or immediately to suspend or terminate your Service, if the use of your Service by you or anyone using it, in our sole discretion, violates the Agreement or other Tenmeya policies, is objectionable or unlawful, interferes with the functioning of the platform, or violates site security. 

16. Intellectual Property

  • You retain ownership of the intellectual property rights to your course content. By hosting your course on Tenmeya, you grant Tenmeya a non-exclusive license to display, market, and sell your course through our platform.

17. Creator Support

  • In addition to your dedicated account manager, Tenmeya will provide support resources such as an FAQ section and a knowledge base.
  • For customer support, you may submit a support ticket through the platform, which will be addressed by your account manager and resolved within 2-3 business days. You will receive updates regarding the status of your ticket.

18. Platform Evolution

  • Tenmeya reserves the right to update the platform and its features to improve user experience and remain competitive.

19. Accessibility

  • Tenmeya is committed to providing an accessible learning experience for all users. We will strive to ensure our platform and services comply with accessibility standards.

20. Updates To This Agreement

  • Tenmeya reserves the right to modify, alter, or otherwise update any of these Terms and Conditions from time to time as it deems fit without the need to serve any prior announcement. The amended Terms will automatically be effective when posted on the site. Your continued use of the site after any changes or amendments in these Terms shall constitute your expressed acceptance of such changes or amendments. 

21. Acceptance

By purchasing any Tenmeya package, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions.
